After topping complaints register.

NSW Fair Trading has commenced injunction proceedings against Digital Marketing and Solutions Pty Ltd, which trades as Android Enjoyed and CameraSky, as well as its sole director Yuen Ho Wong.

Minister for Better Regulation, Matt Kean said the company and its sole director, who is based in Hong Kong, operate an e-commerce retail business, supplying consumer goods to Australians, including mobile phones, cameras, camera accessories and other electrical goods.

“Fair Trading is alleging the business failed to repair defective goods, provide refunds for defective or damaged goods or goods not fit for purpose, and failed to supply goods in a reasonable time or at all,” he said.

Fair Trading issued a public warning on September 6, 2016 about dealing with the Digital Skies group after it received numerous complaints about the quality of goods sold, the acceptance of payment without supplying the goods, the supply of goods not suitable for the Australian market and other Australian Consumer Law offences. A further public warning was issued in April 2018.

“Android Enjoyed has appeared on the NSW Fair Trading Complaints Register 17 times since July 2016, with a total of 604 complaints made by consumers about the business and been at the top of the Complaints Register on five separate occasions since September 2016. CameraSky has appeared on the Complaints Register six times, with 178 complaints made by consumers. These are figures no company should be proud of,” the minister said.

Proceedings are listed in the NSW Supreme Court for September 26, 2018.
